Terms of Service

These Terms of Service (“Terms”) govern your use of the AinaOpen website at ainaopen.com and the use of AinaOpen smart vending machines (including the Nicomatic AI Vending by AinaOpen units). By using the website or by starting to shop at a vending machine you accept these Terms. If you do not accept them, please do not use the service.

AinaOpen is provided by AinaOpen Oy, registered in Finland.

1. Use of the Website

The AinaOpen website is provided for informational and commercial purposes. You agree to use it only for lawful purposes and in a manner that does not infringe the rights of, restrict or inhibit any other person’s use of it.

2. Orders and Quotations

Information about cabinets, prices and SaaS fees on this website is indicative. A binding agreement is formed only when AinaOpen confirms an order in writing. Prices are quoted excluding VAT unless stated otherwise.

3. Use of AinaOpen Vending Machines

The following terms and practical instructions apply to every shopping session at an AinaOpen vending machine:

  • These terms of use apply when you use the Nicomatic AI Vending by AinaOpen vending machine.
  • By starting to shop, you accept these terms.
  • Only payment cards are accepted as payment method in the store.
  • A deposit reservation is made on your payment card so you can open the cabinet.
  • Age verification is done with strong authentication using bank credentials (TUPAS) in accordance with SCA regulations. If the legal age requirement is not met, the cabinet door will not open.
  • When you use the vending machine with the same bank card within 30 days, age identification is only done randomly. We store age verification linked to the bank-card identifier for 30 days.
  • The cabinet door only opens when the deposit reservation has been successfully made.
  • You are responsible for all purchases made from the cabinet opened with your payment method. Completed purchases will be charged to the card. Violations and misuse of the terms as well as identity will be immediately reported to the authorities. Products taken from the cabinet will be charged to the person who has verified their identity and, if necessary, transferred to debt collection.
  • As the opener of the cabinet door, you are responsible for the products taken from the cabinet and their charges. Distribution and resale of products to minors is prohibited.
  • By closing the cabinet door, you have made a purchase decision for the products that have been taken from the cabinet during that shopping session.
  • When opening the cabinet, make sure there are no other customers in the immediate vicinity. Only the person who showed the payment card on the start screen may open the cabinet.
  • You can see your purchase receipt on the info screen and order the receipt to your email at www.nicoteca.com/kuitit, or by taking a photo of the info screen after showing your bank card again.
  • Do not return products to the cabinet after closing the door once. They will not be refunded, as the purchase decision is made when you close the cabinet.
  • The charge occurs and the transaction ends when you have closed the cabinet door.
  • The premises have recording camera surveillance.
  • Moving the cabinets is prohibited.

4. Consumer Rights

Nothing in these Terms limits your statutory rights as a consumer under EU consumer protection law and the Finnish Consumer Protection Act (38/1978). The right of withdrawal does not apply to in-person purchases from a vending machine, or to products that by their nature cannot be returned (for example sealed food and beverages once opened).

5. Intellectual Property

All content on the website, including logos, text, images and software, is the property of AinaOpen Oy or its licensors and is protected by copyright and trademark laws. You may not copy, modify or redistribute it without our prior written consent.

6. Limitation of Liability

To the extent permitted by mandatory law, AinaOpen is not liable for indirect or consequential damages arising from the use of the website or vending machines. Our aggregate liability is limited to the amount paid by you for the relevant transaction.

7. Governing Law and Dispute Resolution

These Terms are governed by the laws of Finland, excluding its conflict-of-laws rules. Disputes will be resolved by the competent Finnish courts. Consumers may also refer disputes to the Finnish Consumer Disputes Board (kuluttajariita.fi) or to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
